For registered unions: Notice Board, Check off facilities.
For 5% and above: Notice Board, Check off and informal meeting facilities, Participation in Councils.
For 15% and above: Recognition
Facilities: Notice Board, Check off, formal meeting, Special CL, representation in NC/CC/LC on the basis of secured votes, Accommodation, Immunity.
Membership in the Councils on the Basis Proportional Representation:
National Council: Maximum 30 members from staff side
- Subject to a minimum of 2 for those getting 5 % and above. For recognized unions 1 member for every 3% secured votes
Circle Council: Maximum 25 Members
Subject to a minimum of one member for those getting 5% in All India
One Member for those getting in the Circle alone 5 % and above
For Recognized unions 1 member minimum and maximum of one member for every 4 % as per the Circle votes
Local Council: Maximum 20 Members
Subject to a minimum of one member for those getting 5% and above in All india
One Member for those getting 5% in the SSA alone
For Recognized Unions one member minimum and maximum of one member for every 5% votes in the Local area
In any Circle/Local area if any union other than recognized Union/unions gets 50 % and above then that union may be given additional facility like accommodation
In the National Council Policy Decisions can be taken only when there is near unanimity or 75 % member’s majority. Other issues can be sorted out by simple majority that is above 50%. Sub committees may be formed to sort out issues to avoid delay and to bring consensus
Summary:
• Recognition for those getting 15 % and above in All India
• Council’s placements as per Proportional Representation subject to a minimum of 5 %
• Those who are getting 5 % and above in All India are assured of one minimum in Circle and Local Councils.
• For Recognized Unions, Increased seats on the basis of their votes in the respective Circles/Locals not on the Uniform basis of All India, in order to give local flavor to the democratic verdict
• Decisions of National Council binds all- Circle and Local councils cannot go against the decisions of National Council and so Local council of Circle Council
• In the National Council Policy Decisions can be taken only when there is near unanimity or 75 % member’s majority. Other issues can be sorted out by simple majority that is above 50%. Sub committees may be formed to sort out issues to avoid delay and to bring consensus
• In the Circle and Local Councils if any decision is not accepted by 51% members then that should be referred to higher Councils. Sub Committee method to avoid delay and to bring consensus
• In any Circle/Local area if any union other than recognized Union/unions gets 50 % and above then that union may be given additional facility like accommodation
